STANDARD RULES FOR DAILY CALL IN TO WIN CONTESTS

Cumulus Media, its subsidiaries and affiliated companies, will conduct the Contest substantially as described in these rules, and by participating, each participant agrees as follows:
The Company may conduct the Contest concurrently and simultaneously on several participating radio stations owned and not owned by the Company, and in various States, and the Company may add or remove participating stations or change call letters of any participating station at any time during the Contest as announced on the affected station. Participating stations are listed above.
1. Description of Contest/Participation.
- Dates of Contest: All contests will have specific start dates, and specific end dates. Contest dates will be announced on air or on the web site as appropriate.
- NO PURCHASE NECESSARY. PURCHASE DOES NOT INCREASE ODDS OF WINNING. Void where prohibited. Odds of winning depend upon the number of participants.
- How to Play: Listen to the station weekday mornings for the cue to call in and be the designated numbered caller to the Station’s contest line. The correct caller will either automatically win the announced prize or perform a task (such as answering a trivia question correctly) as determined by the on-air personality.
2. Prize(s). The prize(s) that may be awarded to the eligible winner(s) are: Prizes for Call In to Win Contests vary and will be announced prior to the cue-to-call in. Prize value varies but normally ranged between $10 and $100. Prizes are not transferable, redeemable for cash or exchangeable for any other prize. All prizes must be redeemed within 30 days of the contest end date. If a winner cannot be contacted or is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion. The Company is not acting as the manufacturer or distributor of any prize awarded. The Company makes no warranties with respect to any prize. With respect to any claims for cancelled, postponed, or rained out concert, sporting event or show ticket prizes, winner should look to the provider or others in the chain of production and distribution but excluding the Station and the Company.
3. Eligibility and Limitations. Participants and winner(s) must be U.S. residents at least 18-years old as determined by the Company and reside in the Station’s Total Survey Area (TSA), unless otherwise specifically announced. A parent or guardian of any participant who is a minor must sign a release on behalf of the minor to be eligible to receive a prize, but the Company reserves the right to refuse to award a prize to or on behalf of any minor. Only one (1) entry per person. Only one (1) prize per household for the Contest. Only one (1) prize per household from any of the Company’s stations within any thirty (30) day period. Employees of the Company, the Contest’s participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
4. Telephone and Delivery Disclaimer. If a contest is a call in to win contest and/or a telephone is needed to participate in the Contest, participants are restricted to the use of ordinary telephone equipment. Participants that enable the “Caller ID” block function will not be allowed to participate unless they enter their correct area code and telephone number if prompted, or disable the features inhibiting their participation in the Contest. Participants using equipment not set up for toll free phone exchanges (800, 888, 877, 866, etc.) may experience call connection problems. The Company disclaims all liability for the inability of a participant to complete or continue a telephone call due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Company’s control, or otherwise. For all contests the Company disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. The Company is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest. Entry forms in a register-to-win contest must be handwritten. No photocopies or mechanical reproductions of entry forms is permitted.
5. Publicity; Use of Personal Information. By participating, where allowed by law, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, where allowed by law, participants agree that the Company may disclose personal information obtained from participants in the Contest to participation third parties for purposes of prize fullfillment.
6. Release. By participating in the Contest, each participant and winner waives any and all claims of liability against the Company, its employees and agents, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.
7. Taxes. Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize which are not specifically provided for in the official rules. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
8. Conduct and Decisions. By participating in the Contest, participants agree to be bound by the decisions of Company personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Miscellaneous. Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize. The Company may substitute prizes, amend the rules or discontinue the Contest at any time as announced on the Station(s). The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. For a copy of the rules, or where required by law, a list of winners, visit the business office of the Station during normal business hours or mail a written request with a stamped, self-addressed return envelope to the Station’s address, listed above. All entries become the property of the Company and will not be returned. To be removed from our direct mail, email or fax lists, visit the main office of the Station during regular business hours, or send a self addressed stamped envelope with contest name to Cumulus Media Harrisburg Contests, 2300 Vartan Way, Harrisburg, PA 17110.
10. Compliance with Law. The conduct of the Contest is governed by the applicable laws of the Unites States of America, which take precedence over any rule to the contrary herein. Station(s) shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.

Prizes must be picked up at Cumulus Media Harrisburg Offices at 2300 Vartan Way, Harrisburg unless otherwise specified.

OFFICIAL RULES & HOW TO PLAY
August 5, 2007 – January 26, 2008
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT IMPROVE CHANCES OF WINNING. THE FOLLOWING CONTEST IS OPEN TO LEGAL RESIDENTS OF PENNSYLVANIA ONLY, WHO MEET THE ELIGIBILITY REQUIREMENTS (AS DEFINED IN THE RULES BELOW). VOID ELSEWHERE AND WHEREVER PROHIBITED.
Promotion Period: Contest registration is scheduled to begin on 8/5/07 and end 12/30/07 (the “Registration Period”). The grand prize contest event is scheduled to occur on 1/26/08 at the PA Auto & Boat Show. The contest is subject to all applicable federal, state and local laws and regulations and is void where prohibited.
Who May Enter: Contest is open to legal residents of Pennsylvania, who are age 18 or older as of date of entry with a Pennsylvania valid driver’s license and live in the “717” area code, except the following classes of persons who are not eligible to enter:
- (a) Employees, officers, and directors of Cumulus Broadcasting, LLC, Sutliff Chevrolet, Lebanon Valley Cycles, participating registration locations (“Sponsors”), each of their respective franchisees, affiliated companies, subsidiaries, distributors, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of this contest (collectively, “Released Parties”) and the members of the immediate families or households of any of the above, whether or not related. “Immediate family members” includes, for purposes of this contest, parents (including in-laws), grandparents, siblings (including step-siblings), children (including step-children), grand children (including step grand children) and each of their respective spouses.
- (b) Individuals who are unable or unwilling to attend or participate in the grand prize contest event (scheduled to occur on 1/26/08).
How to Enter – Two Ways:
- WTPA-FM Steelers Tailgate Parties – Official entry forms will be made available (while supplies last) at each WTPA-FM Steelers Tailgate party between the Registration Period hosted at designated locations in the Central PA metro area. Tailgate parties will be hosted before and during each 2007 Pittsburgh Steelers Pre-Season and Regular Season game. Listen to WTPA-FM for designated weekly host locations or visit the website www.935wtpa.com. Join the designated location during the scheduled Tailgate Party times, fully complete an official entry form with all required information and deposit completed entry in to the provided registration box.
- WTPA-FM Station Appearances – Official entry forms will be made available (while supplies last) at designated WTPA-FM Station Appearances in the Central PA metro area between the Registration Period. Listen to WTPA-FM for the dates, times and locations of designated station appearances where entry forms will be distributed. Join the designated event at the date, time and location designated, obtain and fully complete an official entry form with all required information and deposit completed entry in to the provided registration box.
Maximum of one entry per person per event date. Any contestant submitting more than one entry will void all entries by that contestant. Contestants may only enter on their own behalf. Any contestant submitting an entry on behalf of another individual will void all entries submitted by that contestant. No photocopied or mechanically reproduced entries permitted. All eligible entries must be received by 12/30/07. Released Parties are not responsible for entries that are lost, late, misdirected, illegible, incomplete, inaccurate, damaged, or for lost or stolen entry boxes or for entries submitted in a manner that is not expressly allowed under these rules. All such entries will be automatically void. All entries received become the property of the Sponsor and will not be returned
Finalist Selection & Notification:
A maximum total of (63) eligible finalists will be selected to participate in the grand prize contest event as follows:
- WTPA-FM Steelers Tailgate Parties – A random drawing will be held from among all eligible entries received during each WTPA-FM Steelers Tailgate Party (one at the end of the first quarter of play and a second at the conclusion of the first half of the game) to select a total of (2) finalists per event. The random drawing will be conducted during each of the (21) events to select a total of (42) finalists.
- WTPA-FM Station Appearances – Random drawings will be held from among all eligible entries received during each designated WPTA-FM Station Appearance to select total of (21) finalists from among all station appearances. WTPA-FM will designate the number of finalists scheduled to be selected from entries received at each appearance.
Maximum of one (1) finalist per household. Selected finalists may receive a maximum of one (1) attempt to participate in the contest. Once a contestant has been selected as a finalist any additional entries by that contestant or any members of their household are void.
Each selected finalist will be announced at each event, and/or notified by phone of their selection. Any selected finalist who cannot be reached or contacted to confirm their selection after announcing their name at the event or after an initial attempt to contact the finalist at the phone number listed on their entry, will be disqualified and an alternate finalist may be selected and notified, time permitting. Any selected finalist who does not meet the eligibility requirements, does not wish to participate in the grand prize contest, or who is unable or unwilling to attend the grand prize event will be disqualified. An alternate finalist will then be randomly selected per the procedures outlined above, time permitting. Decisions of judges in the selection of finalists, and all matters related to this contest are final.
Selected finalists must be present at the date, time and location as specified by sponsor to participate in the grand prize contest (scheduled for 1/26/08 at the PA Auto & Boat Show at the PA Farm Show Complex on Cameron Street in Harrisburg, PA—exact time to be determined). Qualifiers must be present to win. No proxies will be accepted. Qualifiers must be present at the finale to have a chance to win. Qualifiers must register on site at the finale between (time to be determined), or they will forfeit their spot in the grand prize contest. Qualifiers will be assigned numbers (the first person to register will be assigned number one, the second person to register will be assigned number two, etc.). 93.5 WTPA will draw the numbered slips of paper at random from the registration box to determine the order in which finalists will roll the dice. The first numbered slip drawn will have first opportunity to roll the dice. Any finalist who fails to appear by the required deadline at the date, time and location as designated by sponsor will be disqualified. Sponsor reserves the right in its sole discretion to reschedule the date, time or location of the grand prize contest. Selected finalists will be notified of any changes either at the time of their notification, or will be contacted by sponsor and notified of any change(s).
Only the (63) finalists selected and notified by sponsor will be eligible to participate in the grand prize contest. All other entrants are ineligible. A maximum of (63) eligible finalists will be allowed to participate in the contest. Finalist selection and participation is non-transferable. No other individual may participate on behalf of a selected contestant. Difficulties with getting to location to enter or participate in the contest are not the responsibility of Sponsors. If any selected finalist fails to appear at the required date, time and location to participate in the grand prize contest, sponsor reserves the right to select alternate finalists from those present at the grand prize event at its sole discretion.
Grand Prize Contest: In order for a grand prize to be awarded to an eligible finalist, the finalist must print and sign their full name on the first unoccupied line of the provided official contestant registration form prior to their dice roll attempt. The eligible contestant must then roll all 8 dice provided by Sponsor in the presence of the designated contest administrator, and have each die come to rest with the predetermined winning side face up.
The winning symbols for this contest are: S-T-E-E-L-E-R-S. Each winning symbol will appear on a maximum of one side of one die, with the exception of (3) guaranteed die. The (3) guaranteed die will each be printed with the winning symbol on all 6-sides of the die. The designated guaranteed die will each be printed with an “E” on all 6-sides. In order to claim the grand prize contestants must get each of the (5) non-guaranteed die to land face-up on the winning symbols S-T-L-R-S. If no eligible finalist successfully throws a winning dice roll according to these Official Rules, then the grand prize will not be awarded.
The following requirements apply in order to be considered an eligible dice roll attempt:
- All dice roll attempts must occur in the presence of the contest administrator(s), and must be recorded on video tape in its entirety. Any dice roll attempt not in the presence of the contest administrator, or that is not video taped for any reason will be disqualified and is not eligible for the grand prize;
- Contestant will not be permitted to take any practice or warm-up tosses prior to their attempt. Once a die has been rolled, their attempt is considered to be started.
- Each eligible contestant must roll all (8) dice. Once a die has landed and come to rest – its outcome is final and may not be changed by any additional rolls. Contestants may not attempt to change the outcome of any rolled die, by hitting the die with a subsequent roll attempt;
- Each die must be tossed in a completely random manner that does not allow the contestant to “set” the dice, alter or influence the random outcome of the roll;
- Each die must be rolled a minimum of three (3) feet in height and ten (10) feet in distance from the contestant, in order to prevent the contestant from altering, affecting, influencing, or enhancing the random outcome of any roll. The contest administrator will designate the demarcation line that each die must cross during the roll attempt;
- All dice must come to rest lying flat;
- All dice must land on and remain on the designated dice rolling surface;
- No rolled die may come in contact with any person or object other than the designated rolling surfaces or walls.
- If any die comes in contact with another person or object (other than the dice roll surface or designated walls or backstop) for any reason; or if any person or object in any way interferes, alters, changes, influences or affects the random outcome of the roll, then the entire attempt is disqualified and the contestant may not receive another attempt.
The following will result in the contestant being required to re-roll their entire dice roll attempt:
If any of the following outcomes occur, that dice roll attempt is disqualified and the contestant will be granted a maximum of one re-roll attempt (the contestant must re-roll all dice during any re-roll attempt):
- If the contest administrator deems that any die has failed to cross the dice roll demarcation line;
- If any die is leaning in any manner;
- If any die leaves the designated dice roll playing surface or area;
- If any contestant inadvertently drops a die as they are preparing to roll, and the dropped die does not meet the eligible dice roll requirements as stated in the contest rules.
In all circumstances, an eligible contestant may have a maximum of one re-roll attempt. In the event of a second ineligible dice roll, their entire dice roll attempt will be disqualified and the contestant will not be eligible for any prize claim regardless of the outcome of their roll.
Prize Awards & Delivery:
Finalist Prize:
Each selected finalist will be awarded (4) tickets for admission to the PA Auto & Boat Show at the PA Farm Show Complex on 1/26/08. Approximate retail value (“ARV”) of admission tickets: $32. All finalists must pre-register at the 93.5 WTPA business office during normal business hours (Monday through Friday from 8:30am until 4:30pm) no later then Friday, January 18, 2008. All qualifying contest winners must sign a contest release waiver. Qualifying winners will also receive and must sign a copy of these contest rules. Failure to execute the waiver or rules will result in forfeiture of participation in the Grand Prize finale on January 26, 2008.
Grand Prize:
In the event of a successful dice roll attempt, the eligible contestant will be awarded the grand prize subject to verification and approval by Million Dollar Media, LLC. The grand prize is: a 2007 or 2008 Chevrolet Silverado from Sutliff Chevrolet with a maximum retail value of $30,000, including sales tax. Sponsor will solely designate and specify available vehicles including make, model, color and options for contestant’s prize selection. Selected vehicle must be one of the sponsor designated vehicles that are currently in sponsor’s stock of inventory. 93.5 WTPA shall not be responsible for the failure of participating sponsors to deliver prizes as promised.
A maximum (2) grand prizes will be awarded to the first two (2) contestants who successfully complete the dice roll contest requirements. The contest is immediately concluded following the first two (2) successful attempts, regardless of the number of completed rolls – and no additional contestants will be allowed to participate. If no finalist successfully completes the dice roll contest, the grand prize will not be awarded.
Bonus prize:
In the event that no finalist successfully completes a grand prize winning roll, then the finalist who rolled the most winning letters during their eligible attempt will receive the bonus prize. The bonus prize is: a 2007 Suzuki Quadsport ATV with an approximate retail value of $4,000, including sales tax. Sponsor will solely designate and specify available ATV vehicles including make, model, color and options for contestant’s prize selection. Selected vehicle must be one of the sponsor designated ATV vehicles that are currently in sponsor’s stock of inventory. 93.5 WTPA shall not be responsible for the failure of participating sponsors to deliver prizes as promised.
In the event of a tie among eligible finalists who have rolled the most winning letters, then the sponsor shall conduct a roll-off among the tied finalists. The eligible finalist who rolls the most winning letters during the roll-off rounds will be declared the bonus prize winner.
All prizes are awarded “as is” including the Grand Prize Steelers Edition Chevrolet Silverado regardless of mileage and/or condition. Qualifying prizes are nontransferable and cannot be exchanged. The awarding of the grand prize, including transfer of title, will take place between Sutliff Chevrolet and the grand prize winner at a time mutually convenient between the two parties. This will occur no later than February 29, 2008. Prize winner(s) must accept delivery of prize from Sponsor, or as otherwise instructed by sponsor. All other costs related to prize delivery and acceptance are the responsibility of winner including but not limited to taxes, title, insurance, license, and registration fees. All properly claimed prizes will be awarded. Prizes are non-transferable. Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. Winner(s) will be required to complete and return a W-9 form (if prize value exceeds $600.00), affidavit of eligibility, and liability/publicity release and present a valid PA driver’s license and social security card before prize will be awarded. Winners of prizes greater than $600.00 will be issued a 1099 form reflecting the value of the prize(s) and are responsible for paying all income taxes on prize(s).
Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, contestant will not receive any other prize substitution or compensation. Total Maximum ARV of all available prizes: $66,016.
Additional Rules & Restrictions: Cumulus Broadcasting LLC reserves the right to change any of this promotion and or the promotional elements. 93.5 WTPA reserves the right to require contestants to be present at drawings in order to win their prize. 93.5 WTPA also reserves the right to end a contest at any time upon advanced notice to the public. By participating in this contest, entrants agree to abide by and be bound by the Official Rules and the decisions of the Administrator, which shall be final in all matters relating to this contest. In the event an entrant wins a prize, and is later found to be in violation of these rules he/she will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after winner has used the prize. Participation in contest constitutes permission for the Sponsor and its agencies to use winners’ names and/or likenesses for purposes of advertising and trade in any media worldwide without limitation or further compensation unless prohibited by law. False, fraudulent or deceptive entries or acts shall render entrants ineligible for any prize. All entry blanks, forms, devices and materials, as well as all the information contained on or within, gathered during the course of entry, shall become the sole property of 93.5 WTPA, Cumulus Broadcasting LLC, their affiliates and sponsors to be sued, disposed of or destroyed at the discretion of 93.5 WTPA Cumulus Broadcasting LLC, their affiliates and sponsors.
Sponsor and Administrator are not responsible for any typographical or other error in the printing or advertising of the offer, administration or execution of the contest or in the announcement of the prizes/prize winners. By accepting prizes, winners agree to hold sponsor, and released parties (collectively “Releasees”), from any claims, losses, actions, or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to entrant’s participation in this contest, or the acceptance, possession or use/misuse of any prize, or participation in prize-related activities (including but not limited to travel related thereto), and to assume all liability in connection therewith.
Releasees shall not be liable to any winner, entrant or any other person for failure to supply the prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Releasees’ sole control. No more than the advertised maximum number of prizes will be awarded for any reason.
IN CASE OF DISPUTES: By participating, each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of New Jersey; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New Jersey or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of New Jersey.
Odds: Odds of being selected as a finalist are dependent upon the total number of eligible entries received. The odds of a selected finalist winning the grand prize by successfully rolling the dice are: 1:7,776.
